FLIGHT RISK ASSESSMENT SOFTWARE TERMS

Risk assessments are imprecise and subject to a high degree of uncertainty. Use of the flight risk assessment software (Software) is subject to the following terms.

1. While every effort has been made to offer functional and useable Software that is free of bugs and errors, errors can occur. The Software is provided "as is", with no guarantees of functionality, completeness, accuracy or timeliness, and without warranties of any kind, express or implied.
2. To the extent permitted by law, MLA / Livecorp excludes all warranties in relation to the Software, including implied warranties of merchantability and fitness for a particular purpose. MLA / Livecorp does not warrant that the Software will be uninterrupted, error-free, free of viruses or other harmful components.
3. To the extent that the terms implied under the Trade Practices Act 1974 apply to services or goods supplied by MLA / Livecorp, MLA’s / Livecorp’s liability for any breach of those terms is limited to:
   1. in the case of goods, either supplying the goods again or paying the cost of having the goods supplied again; and
   2. in the case of services, either supplying the services again or paying the cost of having the services supplied again.
4. MLA / Livecorp is not liable to you or to any third party for any losses, costs or expenses, including direct, indirect, incidental, consequential, special or exemplary damage or lost profit resulting from any use or misuse of the Software.
5. Except where noted otherwise, MLA / Livecorp owns the Software. No part of the Software, including text, graphics and code, may be reproduced or transmitted in any form by any means without MLA's / Livecorp’s prior written permission.
